Protect your intellectual property rights in Mainland China

You may not feel pleasant when seeing a “copy” of your product in the market. However, there are still some on-going counterfeiting and piracy activities in Mainland China. Therefore, to protect your interest, you should:

  1. register your IP rights ASAP locally, including patents, copyrights, and in particular, trademarks, since the trademark registration system in Mainland China operates on a first to file basis, rather than a first to use basis.
  2. develop a China operation policy for your local subsidiary, from record-keeping to contract control.
  3. seek assistance from lawyers and investigators and spend effort on marketing monitoring, if any infringement activity is identified, take immediate action including,
  • civil action,
  • criminal reporting,
  • demand cooperation from e-commerce operators and related parties according to administrative regulations
