R v Dudley and Stephens, 1884 is a leading English criminal case which established a precedent that necessity is not a defence to a charge of murder.

Dudley and Stephens were shipwrecked along with two other men, and end up drifting on a small lifeboat. When one of them, the cabin boy Richard Parker, fell into a coma, Dudley and Stephens killed Parker for food.

Being saved, Dudley and Stephens were prosecuted and sentenced to the statutory death penalty with a recommendation for mercy.
