The four basic steps for divorce in Hong Kong are as follows:
Step 1: File a divorce petition (Separation is not always a pre-requisite for an application)
Step 2: Prepare and attend for one or more “1st appointment” at court
Step 3: The HK court will handle 3 major matters (a) Divorce Main Suit, (b) Children, (c) Ancillary Relief ($). The proceedings (that require input from both parties and/or their lawyers) will take at least a few months and could extend for a few years in some cases.
Step 4: At any time during the proceedings, the parties may initiate a Mediation Process to resolve their dispute. If the dispute is not settled, the case will eventually go to trial.
